How Are Divorce And Separation Different?

Separation is not a separate legal process in Florida. If a couple decides to live separately, it may afford time to engage in counseling and reflect on options, while maintaining benefits of marriage, such as filing joint taxes or sharing family health insurance. Parties can enter into agreements after separating to address parenting, support and property division. The marriage is still valid unless the couple proceeds with divorce. If parties cannot reach agreement, the Florida courts will address requests for counseling, support and parenting matters without a request for divorce.
